This terms and conditions of use template is designed for websites that generate commercial leads, where those leads are passed on to other businesses, whether in exchange for payments or otherwise.
If you operate a lead generation website, you should ensure that your terms and conditions make it clear that you are not a party to, and will not be liable under, any contract entered into between the user and a business that sources a lead from your website. This terms and conditions template does just that.
As well as the standard lead generation website T&Cs, we publish a special version for financial services lead generation websites. These special terms and conditions include a specific disclaimer concerning financial information. However, the document is not suitable for businesses conducting any activity that is regulated under financial services law. If you are uncertain whether you business is regulated, you should take specialist legal advice. The T&Cs also include provisions requiring users outside the UK to take responsibility for their own legal compliance.
Compliance with data protection law is another key legal issue in the operation of a lead generation website. Leads will usually include personal data (such as individual names and contact details). Businesses acquiring leads will usually be "data controllers" in their own right in respect of that information. In other words, the acquiring business will be able to determine the purposes for which the data are processed. Your privacy policy should reflect these issues.
