This recruitment terms and conditions template is designed for use in relation to websites that advertise jobs and enable jobseekers to get in touch with recruiters. The template assumes that recruiters will pay the website operator for access to some or all of the services on the website, whereas the website will be free for jobseekers. Exactly what is being paid for will vary from website to website.
Distinct sections are included dealing with jobseeker accounts and recruiter accounts. In respect of each type of account, the services to be provided can be defined on the website or specified in the terms and conditions.
A special disclaimer of responsibility for the behaviour of other website users is included. The website operator is not responsible to jobseekers for the behaviour of recruiters, or to recruiters for the behaviour of jobseekers.
In addition to the base version of these recruitment terms and conditions, we publish a slightly longer version containing provision covering typical social networking features.
If you plan to run a website with recruitment functionality, you should take advice on the question of whether your business will be an "employment agency", and therefore regulated under the Employment Agencies Act 1973 and the Conduct of Employment Agencies and Employment Businesses Regulations 2003. This document has not been specifically drafted to take account of the requirements of this legislation and, if your business is an employment agency, it will need to be significantly amended to comply with the legislation.
