The key documents in this pack are a pair of terms and conditions covering: (i) photography services generally; and (ii) wedding photography services. These documents can be used to create standard terms for customers of the business. The terms and conditions are relatively detailed, as the legal issues relating to the provision of photography services can be relatively complex.
Alongside the basic obligations to provide and pay for the agreed services and the usual boilerplate, the terms and conditions include clauses covering the obtaining of permissions (such as location permissions), the delivery of photographs files and prints, acceptance of the photographs by the customer, client co-operation obligations, client materials incorporated into the website, and the transfer and/or licensing of copyright and other intellectual property rights. Many of these provisions are optional, and all can be adapted to suit the circumstances in which the terms and conditions are being used.
This pack also contains three purely copyright-related documents: a notice for asserting ownership or control of copyright, a licence of copyright, under which a person may be granted a right to use a photograph, and an assignment of copyright for transferring ownership.
